California · time limits

Two years is a starting point—not a deadline calculator.

California commonly allows two years for personal-injury lawsuits, but government claims, medical negligence, minors, delayed discovery, and other facts can change the analysis.

01

The general rule

California Code of Civil Procedure section 335.1 generally provides two years for an action involving injury or death caused by another person’s wrongful act or neglect.

02

Why exceptions matter

A claim against a public entity can require action much sooner. Different rules can apply to medical negligence, property damage, minors, and injuries discovered later. Settlement talks or an open insurance claim do not automatically preserve a court deadline.

03

Use the right source

The California Courts Self-Help Guide cautions that limitation periods are fact-specific. If timing is uncertain, get legal advice promptly rather than relying on a generic date on a website.
